Depends.
Some no fault states have you make a choice before you get a car insurance policy. You can either choose to have very low premiums and give up the right to sue, or you can have higher premiums and have the right to sue. If you do get the right to sue, though, it will be hedged in by things called thresholds.
There are two kinds of thresholds, dollar and verbal. If you have a dollar threshold and the claims go over that amount, then you are legally able to sue. If you have a verbal threshold, then your policy will describe what the situation needs to be before you are able to sue. Normally, these thresholds are very high, such as the verbal one being that you have to have an injury that makes you lose your job or something similar.
